"One Punch Can Kill" Challenged

The prosecution's use of the "one punch can kill" slogan during a Supreme Court trial that jailed a man who killed a young Broncos player with a single punch could help him have the conviction overturned on appeal.

 

Wally James Hung, 23, was jailed for six years and 10 months in May after a Supreme Court jury found him guilty of the manslaughter of Bribie Island Warrigals' star five-eighth and Queensland Rugby League player Todd Parnell, 22.

 

Hung fronted the Court of Appeal this morning citing numerous grounds, including a claim Supreme Court Justice George Fryberg may have "misdirected the jury" in relation to the "accident" by allowing the appellant's "subjective knowledge that 'one punch can kill' be considered without giving sufficient guidance as to its proper use".
